Terms of Service
The following Terms & Conditions govern the use and services of STD Test Express (the "Site") and Analyte Physicians Group, S.C. ("APG"), its authorized agents and you, the Patient.
Provision of the Service: APG is a group medical practice, incorporated in the state of Illinois, employing physicians and other healthcare providers licensed to practice medicine in all 50 states and the District of Columbia. APG physicians and other healthcare providers are specially trained to practice medicine in the area of STD testing and related services (the "Service") to patients via the Site and other telecommunications technologies, such as email, chat and telephone. APG has certain authorized agents, including Consult-A-Doctor, Inc., that you may interact with in receiving the Service.
Use of the Service: By using the Service, you signify your acceptance of the terms and conditions of this Terms of Service. If you do not accept these terms and conditions, you should not use our Service. By using the Service, you understand and agree to the following:
- You are eighteen (18) years of age or older.
- You are not pregnant.
- At this time you do not have any of the following symptoms:
- Fever in excess of 100.5° F
- Stomach or abdominal pain
- Vomiting
- You are a patient of APG and enter into a patient-provider relationship with the healthcare provider that APG assigns to you.
- Your APG healthcare provider is testing you only for the sexually transmitted diseases or infections included in the tests purchased by you and not for all possible sexually transmitted diseases or infections.
- While individual tests are offered, if you are concerned about a possible exposure, your APG healthcare provider recommends that you get tested for all sexually transmitted diseases and infections offered on the Site. You acknowledge that if you are concerned about a possible exposure and are not getting tested for all conditions offered on the Site, you are not adhering to the recommendation of your APG healthcare provider.
- Your APG healthcare provider will order certain diagnostic tests for you and such testing will be provided by an independent clinical reference laboratory ("Lab"). You will be instructed to visit a Lab location and provide blood and/or urine samples at that location. The Lab will perform diagnostic tests on those samples and deliver the test results back to your APG healthcare provider.
- Your test results should be ready in 2 to 3 business days. You will receive an email from APG instructing you to sign in to your account on the Site and view your test results, and for certain types of test results you will be offered the opportunity to speak with an APG healthcare provider at no additional cost to discuss your test results.
- While the tests performed on your samples have been approved by the FDA and are highly specific and highly sensitive, as stated on the Site there is a statistical possibility of a false-positive or false-negative result.
- It is possible to have an "indeterminate" test result for a variety of reasons. If your test results return as "indeterminate", your APG healthcare provider will discuss it with you and discuss your options.
- Your encounters with APG will be stored electronically. APG will not release any information about your encounters without your consent, and will protect your information to the fullest extent allowed by applicable law. However, APG will provide certain information to government authorities to comply with the reporting requirements of your state's public health department. Based on certain positive test results and the state you live in, APG may be required by law to submit the name and address you supplied to us to your state's Department of Public Health.
- You are not a resident of NY, NJ or RI. APG currently does not provide the Service to residents of those states.
- You should consult with an APG healthcare provider or other qualified healthcare provider regarding any health concerns. You agree to contact an APG healthcare provider at 888-215-9543 during the hours of 8AM to 6PM Central Time or another healthcare provider immediately should your condition change or any symptoms worsen. If you require urgent care or care outside of normal business hours, you should contact your local emergency services immediately.
- You will not misrepresent your identity or impersonate another person.
- You are making an informed consent decision to submit to the Service, and have been given all necessary and relevant information to make that decision. If you need more information to make this decision, you may call 888-215-9543 during the hours of 8AM to 6PM Central Time.
- Your relationship with APG is governed by the laws of the State of Illinois, and that any legal matters between you and APG would be addressed in the Circuit Court of Cook County, Illinois, or the United States District Court for the Northern District of Illinois.
Informed Consent with the Lab: The Lab, at their discretion, may require you to review and execute an Informed Consent agreement prior to collecting your blood and/or urine samples.
Use of the Site: By using the Site, regardless of whether you use the Service, you will not violate the copyright protection of all images, text, audio, video and other animations on the web site as they are the intellectual property of APG. You are not permitted to copy, document, modify, reverse engineer, reverse assemble or otherwise attempt to duplicate the content of the said intellectual property. You will not use the Site for illegal purposes of any kind.
Payment of Fees: Your payment to APG is a comprehensive fee for the medical services provided by APG. Your account will not be charged further without your affirmative consent. The fees paid to APG may not be covered by your health insurance plan.
Service Reliability and Warranties: APG makes no warranties or representations of any kind, whether expressed or implied for the use of its Site or any opinions offered by its Customer Service personnel. We do not warrant the accuracy or completeness of the information, text, graphics, audio, video, animations, links or other items contained on the Site. Any of the information offered on the Site may change at any time without notice.
APG may among other things withdraw, suspend or discontinue any of the functionality or content in its Site.
Indemnification: You release, indemnify and hold APG, its employees, officers, directors, affiliates and agents harmless from all liabilities, claims, expenses arising from injury or personal damage that occurs while you are on laboratory premises or with respect to any testing ordered by your APG healthcare provider for you.
Cancellations/Refund & Order change Policy: You can cancel or change your order anytime prior to your visit to the laboratory test center. You can contact us at 888.215.9543 during our business hours to cancel or change your order. We cannot, however, refund any portion of your fees 21 days after your payment of the fees.
Notice: APG will generally use the e-mail address provided by you for all communication and in some instances written communication delivered by U.S. mail to your address on record with APG. You can contact us via written mail to our offices located 351 W.Hubbard Street, Chicago, IL 60654, Attn: Customer Services on all matters relating to your order or services provided by APG.
